WhatGenius is a business messaging platform that enables businesses to communicate with customers on WhatsApp using the official WhatsApp Business Platform and WhatsApp Cloud API.
The Service provides tools to:

- Send notifications and campaigns
- Create and use Meta-approved message templates
All usage is intended to follow WhatsApp Business Platform rules in a structured and responsible manner.
Article 2 – Eligibility
Requirements
To use WhatGenius, you represent and warrant that:
- You are a business or an authorized representative of a business
- You comply with all applicable laws and regulations
- You comply with WhatsApp Business Platform policies
- You are responsible for ensuring that your use of the Service is lawful
Article 3 – WhatsApp Platform Compliance
Platform rules
By using WhatGenius, you agree that:
- All messaging must comply with WhatsApp Business Platform rules
- Messages are sent only to users who have provided valid opt-in
- Message templates must be approved by Meta before use
- Users must be able to stop receiving messages at any time
- Unsolicited messaging is not permitted
WhatGenius does not support unsolicited or non-compliant messaging.
Article 4 – Business Responsibilities
Accountability
Businesses using WhatGenius are solely responsible for:
- Collecting, managing, and documenting user opt-in and consent
- The content and purpose of messages they send
- Compliance with WhatsApp policies and applicable laws
- Respecting user preferences, opt-outs, and requests
WhatGenius provides technical infrastructure only and does not control business messaging decisions.
Article 5 – Prohibited Use
Restrictions
You may not use WhatGenius to:
- Send unsolicited, deceptive, or misleading messages
- Circumvent WhatsApp approval, consent, or policy requirements
- Violate WhatsApp policies or applicable regulations
- Engage in spam, abuse, fraud, or unlawful activity
Violation of these rules may result in suspension or termination of access.
Article 6 – Data Processing
Data handling
WhatGenius processes message data and related information on behalf of businesses to provide the Service.
Data processing is governed by:

- Our Privacy Policy
- Applicable data protection laws
Article 7 – Service Availability
Service level
We aim to provide a reliable and stable service; however, uninterrupted availability is not guaranteed.
WhatGenius may be updated, modified, suspended, or temporarily unavailable due to maintenance, upgrades, or operational requirements.
Article 8 – Suspension and Termination
Access control
We may suspend or terminate access to the Service if:
- These Terms are violated
- WhatsApp policies are breached
- Use of the Service creates legal, regulatory, or compliance risks
Termination or suspension does not relieve businesses of their obligations under applicable laws.
Article 9 – Limitation of Liability
Legal protection
To the maximum extent permitted by law, WhatGenius and AppGenius SARL shall not be liable for:
- Business messaging decisions made by users
- Losses arising from improper or unlawful use of the Service
- Actions taken by WhatsApp or Meta related to policy enforcement

Continued use of the Service after changes constitutes acceptance of the updated Terms.
